1. Acceptance of Terms

By accessing and using the Vibehost platform, you agree to be bound by these Terms of Use. If you do not agree to these terms, you must not use the Service. Vibehost reserves the right to modify these terms at any time, and your continued use of the Service after any modifications constitutes your acceptance of the revised terms.

2. Service Description

Vibehost is a self-hosted Platform as a Service (PaaS) that enables users to deploy web applications. The Service includes:

• Automatic framework detection and AI-assisted deployment configuration
• Container orchestration and application lifecycle management
• Database provisioning (PostgreSQL, MySQL, Redis)
• Dynamic routing and TLS certificate management
• Real-time log streaming and deployment tracking

3. Account Registration and Security

You must provide accurate and complete information when creating your account. You are responsible for maintaining the confidentiality of your credentials and for all activities that occur under your account.

You must notify us immediately of any unauthorized use of your account or any other security breach. Vibehost will not be liable for any loss resulting from unauthorized use of your account.

4. Acceptable Use

You agree not to use the Service to:

• Violate any applicable laws or regulations
• Deploy applications containing malware, viruses, or harmful code
• Attempt to gain unauthorized access to other accounts, systems, or networks
• Mine cryptocurrency or run compute workloads unrelated to application deployment
• Send spam, phishing, or any unsolicited content from deployed applications
• Overload infrastructure through denial-of-service attacks or resource abuse
• Deploy applications hosting or distributing pornographic or adult content
• Run torrent clients, peer-to-peer file sharing, or similar high-bandwidth relay services
• Host streaming or proxy services designed to consume disproportionate bandwidth or storage

All deployed applications must make reasonable use of computing resources (CPU, memory, bandwidth, storage). Vibehost reserves the right to throttle or suspend any application that consumes disproportionate resources, negatively impacts the platform's performance, or exceeds fair usage thresholds. We may contact you before taking action when circumstances allow.

5. Intellectual Property

You retain all intellectual property rights to the code, data, and content you deploy through Vibehost. Vibehost does not claim any ownership rights over your content.

Vibehost and its underlying technology, including software, documentation, and branding elements, remain the exclusive property of Vibehost and its licensors. You are granted a limited, non-exclusive, non-transferable license to use the Service in accordance with these terms.

6. Service Availability

Vibehost strives to maintain high availability of the Service but does not guarantee uninterrupted uptime. The Service may be temporarily unavailable for maintenance, updates, or circumstances beyond our control. Vibehost will not be liable for any interruptions or data loss resulting from Service outages.

7. Data and Content Ownership

You retain full ownership of all source code, application data, and content deployed on Vibehost. Vibehost only accesses your content to the extent necessary to provide the Service, including AI-assisted project analysis, deployment configuration, and migration execution.

Upon termination, you may request an export of your data within thirty (30) days. After this period, Vibehost may delete all associated data.

8. Limitation of Liability

To the maximum extent permitted by law, Vibehost's total liability for any claims arising from the Service is limited to the amount you paid for the Service during the twelve (12) months preceding the claim. Vibehost will not be liable for:

• Indirect, incidental, special, consequential, or punitive damages
• Loss of profits, data, business, or opportunities
• Cost of procurement of substitute services

9. Suspension and Termination

Vibehost may suspend or terminate your access to the Service immediately if you violate these terms, if your usage poses a security risk, or if required by law. During suspension, your payment obligations remain in effect.

You may terminate your account at any time. Vibehost may terminate the Service with thirty (30) days' notice. Upon termination, your right to use the Service ceases immediately.

10. Modifications to Terms

Vibehost reserves the right to modify these terms at any time. Material changes will be notified via email or through the Service dashboard at least thirty (30) days before taking effect. Your continued use of the Service after the effective date constitutes your acceptance of the modified terms.

11. Governing Law

These terms are governed by the laws of Switzerland. Any disputes arising from these terms or the Service will be subject to the exclusive jurisdiction of the courts of Geneva, Switzerland.
